Many motorists just accept a speeding offence and receive points on their licence or in certain circumstances a driving disqualification through the totting up procedure or a charge of dangerous driving. Speed camera - laser devices
There are a number of laser devices that are currently the subject of Home Office Type Approval. The devices must be operated in the correct manner, but in reality they are frequently operated incorrectly which can provide us with an opportunity to argue that this evidence should be excluded.
If you have been caught by a speed camera you will receive a Notice of Intended Prosecution within 14 days of the date of the offence. This is called a S.172 notice. You must by law complete this form and return it within 28 days. If you ignore the notice you may have to go to court. If you are the named driver you will receive a Fixed Penalty Notice (FPN) or a letter telling you to attend court. Speak to us before you accept a FPN or a letter to attend court. If you plead guilty you pay a £100 fine and have 3 points added to your licence unless you are given the option to attend a speed awareness course. You may be given the option of attending a speed awareness course if the police decide it is appropriate for the offence and you have not been on such a course in the past 3 years.
If you plead not guilty, you will have to go to court and your case will be listed for a trial. Contact GT Stewart and speak to one of our motoring experts before you make such an important decision. If you are a new driver (still within 2 years of passing your driving test), your driving licence will be revoked (withdrawn) if you build up 6 or more penalty points.
